Question: What is a motion to suppress in a Georgia DUI case?
Answer: Motion to suppress is literally just, means to throw it out; it means to basically dismiss that evidence that we’re talking about. In a DUI case, the officer has to produce certain evidence to make the charge stick, and if we’re able to get that evidence thrown out then the prosecutor can’t move forward with the case. And motions to suppress are invaluable. That’s something that we use all the time, but it’s something that’s a lot more easily done from the very start.
