Question: What are the penalties for refusing the Georgia state-administered breath test?

Answer: If you refuse the state-administered breath test, it’s an automatic one-year suspension on your license. But what most people don’t realize is that if we get to that early enough, we can prevent that from happening. Under Georgia law, we have 10 days from the date of the arrest in which to challenge it and request an administrative hearing to save your license. I routinely do that. I have never had one of those go astray. Those hearings are very easily winnable. The biggest thing is that we have got to get to that within 10 days. On day 11, it’s too late.
